If you have been behind the wheel of a car, then the odds are you have had the extremely chatty passenger beside or behind you. Occasionally it’s a friend, occasionally it’s a stranger, but often it is your kids. They get bored, they punch each other, or they ask a million questions.

Any mom or dad can tell you how distracting this can be. You miss exits and turns, you almost get into accidents, and you get to a point where you want to tear your hair out when you turn around and yell at them.

But believe it or not, when it comes to driver distraction, having chatty passengers is nothing compared to driving while talking on the cell phone. And this isn’t just speculation on our part. New studies done at the University of Utah shows those drivers who are talking on cell phones are just as impaired behind the wheel as a driver who is legally drunk. And this is even if they are using hands free devices or headsets.

According to the abstract of the report itself, “…The data indicate that when a driver becomes involved in a cell-phone conversation, attention is withdrawn from the processing of the information in the driving environment necessary for safe operation of the motor vehicle.”

The technical term that they use for this phenomenon is “Inattention Blindness.” As attorneys who protect the rights of car accident victims in Houston, Texas, we would call it, at best, “irresponsibility,” and at worst, “negligence.”

Although the study did not bother to check how driving performance suffers when the driver is texting, fiddling around on his iPod, checking e-mail on their blackberry, putting a movie on the entertainment system or even surfing the internet, we can’t help but think that the end result of those studies would be at least as bad or worse than those who drive while talking on the cell phone.

If each American had their own private road on which they could do whatever they wanted, this wouldn’t be an issue. But the problem is that every American who gets behind the wheel of a car has to share the road with everyone else. Despite all the amazing new safety measures that they have placed in cars over the years, an automobile is still a vehicle that weighs over a ton and can travel just below 100 miles an hour. Safe and responsible driving should be the primary objective of anyone who gets behind the wheel of a car, and talking on the cell phone, whether it is with a hands free device or not, should not even be an option.

In the four decades that we have been helping car accident victims in Houston, Texas, we can tell you from personal experience that the majority of our car accident injury cases come directly from people who get behind the wheel of the car and don’t dedicate their full attention to driving. While it goes without saying that there are some accidents that just happen, due to weather or other circumstances beyond anyone’s control, a great majority of accidents occur due to preventable reasons.

Most any car accident can cause severe injuries, loss of income for the victims, immense property damage and medical bills that are enough to force the victims into bankruptcy. But accidents that were preventable in the first place compound the tragedy, and an accident due to driver distraction (cell phone use, playing with electronics, texting, etc.) is the very definition of distracted driving.

Unfortunately, insurance companies rarely just admit that their driver was in the wrong. They make it a point to draw out almost every damage claim to absurd lengths. At Steve Lee and Associates, we know exactly how insurance companies deny and delay, and we do our best to help our clients avoid all of that.
