Truck Collision Mythsc

If you’ve recently suffered injuries in a truck accident, you may have received a lot of advice from friends and coworkers regarding truck accident claims. Unfortunately, much of this information is often contradictory, creating confusion and uncertainty for collision victims.

Common Collision Myths

  • The same traffic laws apply to both commercial trucks and personal vehicles. The truth is, trucks are often governed under a stricter set of laws than passenger vehicles. The Federal Motor Carrier Safety Administration regulates the trucking industry in an attempt to reduce the frequency of collisions, injuries, and fatalities.
  • Collisions harm truck drivers just as much as passenger vehicle occupants. Truck accidents with passenger vehicles tend to do far more damage to the cars and their occupants. This is primarily due to the tremendous weight disparity between 80,000 pound trucks and 4,000 pound personal vehicles. Even at slow speeds, the force of a truck’s impact on a smaller vehicle can be deadly.
  • Jackknife accidents aren’t the most dangerous type of collision. While jackknife truck accidents can certainly be devastating, underride collisions are even more dangerous. Since trucks are taller with more ground clearance, smaller vehicles can easily slide underneath them. Rollover truck accidents are also deadly, with more than 500 such accidents occurring each year.
  • Truck drivers and trucking companies are seldom liable for collisions. Both truck drivers and their employers are often responsible for accidents. Truckers may be liable for collisions when they violate traffic laws, or fail to inspect and maintain their vehicles. The trucking company may be held liable if it fails to conduct background checks and drug tests on new hires; fails to train drivers and maintain their vehicles; or fails to abide by state and federal transportation regulations.
