Which on-the-job injuries are eligible for Texas workers’ compensation benefits?

Workers’ compensation is an important employee benefit, and many injured workers rely on this coverage to help them recover from workplace accidents. While most employee injuries are covered under workers’ compensation in Texas, there are some exceptions.

Injuries Covered by Workers’ Compensation

Whether employee injuries are minor or serious, most of them are covered by workers’ compensation. These benefits can help a family remain financially stable until the employee has recovered from his injuries. Injuries and illnesses are covered under workers’ compensation law without regard to fault, as long as they are sustained within the course and scope of employment.

Covered injuries may occur at the workplace or elsewhere while the employee is engaged in work-related activities. If a worker is hurt while attending an off-site conference, traveling between work facilities, or working at the home of his employer’s client, his injuries are considered work-related. Common injuries typically covered under workers’ compensation include:

  • Occupational diseases, such as cancer or mesothelioma.

Injuries Not Covered by Workers’ Compensation

While workers’ compensation covers most work-related injuries, there are some exceptions. These may include injuries that occur while the employee is:

  • Involved in a fight that he started.
  • Injured due to acts of God.
  • Intentionally injuring himself.
  • Intoxicated or using illegal substances.
  • Involved in activities unrelated to his job.
  • Engaged in horseplay.
  • Violating state or federal law.
  • Violating company policy.
  • Injured due to the actions of a third party that are unrelated to his work.
