What should I do if someone dies at the scene of my car crash?

Tragically, sometimes car accidents result in the death of one or more vehicle occupants. If you’re involved in a collision and someone passes away at the scene, you need to know how to handle the situation.

Steps to Take After a Fatal Car Crash

When you’re involved in a fatal collision, it’s easy to panic. During a terrifying event you may not know what to do, but here are some steps you must take:

Stop your vehicle immediately

Don’t leave the scene, or you may be criminally prosecuted for a hit and run.

Provide assistance

Don’t move the deceased’s body. Check on the other survivors, including any other drivers, passengers, and pedestrians involved in the accident. Don’t move anyone who is injured. Call 911, and report both the accident and the suspected fatality. Provide any necessary information and assistance to emergency responders, both over the phone and at the scene.

Wait for the police

While you’re waiting for help to arrive, turn on your hazard flashers and raise the hood or trunk of your vehicle to alert other drivers to the accident. Exchange contact details, driver’s license numbers, license plate numbers, and insurance information with the other drivers involved in the accident. Also collect contact information from any witnesses.

Talk with the police

Cooperate fully with law enforcement personnel when they arrive, and inform them of the fatality and any injuries. Only provide facts, and don’t offer your opinions. Don’t admit fault to anyone, even if you believe you may be responsible for the collision. Don’t leave the scene until the police indicate you’re free to go.

Speak With an Attorney

If the deceased in your vehicle accident was a loved one, you may be eligible to pursue a wrongful death claim. These claims are complex, and require the expertise of an experienced vehicle accident attorney. To learn more about what the law offices of Steve M. Lee, P.C., can do for you, visit us on Facebook.
